Affiliate Program

We agree to pay you the affiliate part of the transaction fees (the ”Commissions”) for the referral sales made by you. New users that sign up through a valid affiliate link will get a 10% discount on trading fees for the first 6 months.

If Deribit collects fees in BTC (Bitcoin), Deribit will pay affiliate Commissions in BTC. If Deribit collects fees in ETH (Ethereum), Deribit will pay affiliate Commissions in ETH. If Deribit collects fees in USDC (USD Coin), Deribit will pay affiliate Commissions in USDC.

Participation in the Affiliate Program is strictly limited to clients of DRB Panama Inc. Clients of Deribit FZE are not eligible to participate in the Affiliate Program. By participating, affiliates confirm that their account is registered under DRB Panama and that they are subject to Panamanian law.

Please note that the Affiliate Program is not available to residents of (i) the United Arab Emirates (UAE); and (ii) any other jurisdiction designated as an Excluded Country on our Website (as amended from time to time). Any participation from within the UAE or any other Excluded Country is strictly prohibited.

Participation in the Affiliate Program is personal to the affiliate and cannot be assigned or transferred without the prior written consent of Deribit. Unauthorized assignment or transfer of rights will render the affiliate liable for any resulting Commissions. 

Affiliates may not advertise or promote Deribit’s services on websites or platforms accessible from jurisdictions where such advertising or promotion is restricted, including but not limited to the United States, Canada, and the Netherlands. Affiliates must ensure compliance with all applicable securities laws and other regulations in their jurisdiction.

As an affiliate, you are solely responsible for complying with all applicable tax laws and regulations in your jurisdiction, including the accurate reporting of earnings generated through the Affiliate Program and the timely payment of any taxes, levies, or charges required by law. You must maintain proper records of your affiliate income and provide any necessary tax documentation, such as tax identification numbers or forms, when requested to ensure compliance with legal and regulatory requirements. Deribit will not withhold taxes on your behalf, and any tax obligations arising from your participation in the Affiliate Program remain your responsibility. You agree to indemnify and hold Deribit harmless from any liability, penalties, or losses resulting from your failure to fulfill these tax obligations.

You understand that Deribit does not guarantee or predict any type of profit or response from the Affiliate Program. You agree to hold Deribit harmless from any and all losses, claims, expenses, lawsuits, damages, costs, demands or liabilities, joint or several, of whatever kind or nature, which Deribit may become subject arising out of or relating in any way to your use of the services provided under these Affiliate Program T&Cs. This indemnification applies in each case to and includes, without limitation, attorneys’ fees, costs and expenses actually incurred in defending against or enforcing any such losses, claims, expenses, suits, damages or liabilities.

We reserve the right to change the Affiliate Program T&Cs at any time. The use of our services by you after said changes constitutes acceptance of those Affiliate Program T&Cs. If you do not agree to the new terms and conditions, you may terminate your participation in the Affiliate Program. 

You agree to provide us with such other information relating to your use of this service as we deem necessary or desirable. You agree to notify us if your address, email address, telephone number, billing information changes.

No notices will be sent regarding changes to the Affiliate Program T&Cs. It is the affiliate’s responsibility to review these terms for any changes or updates

Deribit reserves the right to terminate an affiliate’s participation in the program for any violation of these Affiliate Program T&Cs or any other reason. In cases of severe violations, such as participation in bulk email campaigns, termination will be immediate and without notice. Affiliates may also face legal action for such violations.

If at any time any provision of these Affiliate Program T&Cs is or becomes illegal, void or invalid, such invalidity shall not affect the validity of the remainder of the Affiliate Program T&Cs. We will replace such invalid provision by such other provision, which, being valid in all respects, shall have an effect as close as possible to that of the replaced provision.

These Affiliate Program T&Cs constitute the entire agreement between us pertaining to its subject matter and supersedes all of our prior agreements, representations, and understandings.

Any failure or delay by us to enforce any provision of the Affiliate Program T&Cs or to exercise any right under the Affiliate Program T&Cs will not be construed as a waiver to any extent of our rights.

These Affiliate Program T&Cs are governed by the laws of the Republic of Panama.

Disputes, conflict, controversies or claims of any kind in connection with these Affiliate Program T&Cs shall be subject to the sole and exclusive jurisdiction of the Courts of Panama, without regard to Panamanian choice of law principles. No other Court or Dispute Resolution Forum shall have jurisdiction over disputes between us or claims by you against us.
